Introduction
Please read these Terms of Service (the "Terms") carefully before using the DemoMe mobile application (the "App"). The App is operated by Imasara ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal and commercial purposes, subject to these Terms and Apple's Media Services Terms of Use.
App Description
DemoMe is a media editing tool that transforms screen recordings and screenshots into polished demo presentations. All media processing is performed locally on your device.
In-App Purchases
3.1 Pro Upgrade The App offers a one-time (non-consumable) in-app purchase ("Pro") that unlocks additional features. The features unlocked with Pro are as follows:
- Export at 4K resolution
- Removal of DemoMe watermark
- Unlimited video duration (free version is limited to 60 seconds)
User Content
4.1 Ownership You own all media (photos and videos) that you import and export using the App. We do not claim any ownership rights to your content. 4.2 Responsibility You are solely responsible for any content you create, edit, or share using the App. You agree not to use the App to create content that:
- Infringes on others' intellectual property rights.
- Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Violates applicable laws or regulations.
Intellectual Property
The App itself, including its design, code, features, graphics, and branding, is owned by Imasara and protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the App.
Acceptable Use
You agree not to:
- Use the App for illegal purposes.
- Attempt to reverse engineer, decompile, or disassemble the App.
- Remove, alter, or obscure any copyright or other proprietary notices in the App.
- Use the App to infringe on others' rights.
- Interfere with or disrupt the App's functionality.
Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The App will be error-free or operate without interruption.
- The App will meet your specific requirements.
- Defects in the App will be corrected.
- Results obtained from using the App will be accurate or reliable.
Limitation of Liability
To the maximum extent permitted by applicable law, Imasara shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, data, use, goodwill, or other intangible losses, whether direct or indirect, arising from:
- Your use or inability to use the App.
- Unauthorized access to or alteration of your content.
- Bugs, viruses, or other harmful components transmitted through the App.
- Errors or omissions in the App's functionality.
Indemnification
You agree to indemnify, defend, and hold harmless Imasara from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App or violation of these Terms.
Third-Party Services
The App uses Mixpanel for analytics. Your use of the App is also subject to Mixpanel's terms of service and privacy policy. We are not responsible for the practices of third-party service providers.
Termination
We reserve the right to terminate or suspend your access to the App at any time without notice if you violate these Terms or engage in conduct that we determine is harmful to other users or the App.
Changes to Terms
We may update these Terms from time to time. If there are material changes, we will notify you by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after changes are made constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with Japanese law, without regard to conflict of law provisions.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Imasara regarding your use of the App.
